When Colorado announced the cancellation of Donald Trump’s spot on their ballots, Mr. Trump’s opponents, to a person, decried this and loudly claimed that “judges should not decide elections, voters should decide elections.”
In response I say, voters should not decide court cases, judges should decide court cases.
The U.S. Constitution states very few minimum qualifications to run for the office of president: (1) you must be 35 years of age, (2) you must be a naural born citizen, and (3) shall not have engaged in insurrection or rebellion against the Constitution of the United States, or given aid or comfort to the enemies thereof.
This is not for voters to decide. It is for courts to decide.
Elections have consequences.
Insurrections have consequences.
